The schemes will be charged on a scale which is comparable with an average party-and-party scale, which means that the compliant owners are no longer burdened with additional costs, at no fault of their own.

We will report to the trustees and the Managing Agent in an easily understandable way, so that the decision-makers in the scheme understand where in the process of collection the matter is, the next steps that are required and when these milestones are expected to be achieved, making it easy and understandable for a Scheme to collect their outstanding levies.

Our client portal will not only give you an oversight of the entire process but will also give you electronic access to all your legal documents that form part of the collection process.

With Imperium’s litigation solution, it’s a win-win for the Scheme. When a matter reaches finality, the Scheme will recover its arrear levies as well as the legal fees* expended on the recovery of the levies.

*We cannot guarantee that 100% of the legal fees will be recovered because the Attorneys appointed will work on an average party-and-party fee which is agreed with them upfront and is paid to them on milestones achieved. The exact party-and-party fee might differ slightly, and the scheme will only recover the fees on the party-and–party scale as taxed.

How does Imperium Litigation Management work?

A specialist legal advisor will ask you for a few documents for assess the arrear levies from a legal perspective. These documents are:

  1. Ledger Account
  2. Latest Interest Resolution
  3. Latest AGM packs (including notice, minutes, attendance register, budget, Annual Financial Statements, resolutions, notice of levy increase to owners etc.)
  4. Special levy resolution (if applicable)

 

A Contract is drawn up and signed by the Community Scheme Members and Imperium authorising the appointment and payment of Attorneys on behalf of your Scheme.

Instructions are given to our Panel Attorney and your scheme is loaded onto pour Portal making it possible for you have real-time updates of the Collection taking place.

Our experts will monitor the collection and methodology followed and will instruct the Attorneys on behalf of your scheme to ensure a streamlined and correct process will be followed. Compliance with the time periods agreed will be monitored daily ensuring timeous results.

What are the Cost implications for your Scheme?

We understand that having outstanding levies is a burden on any Scheme. This is why we have partnered with Stratafin to offer a loan for the amount as required on the relevant party-and-party scale, and to be paid over a 24-36 month period. You will know upfront what the legal cost for collection will be and that you will recover it at the end of the process from the debtor.

The Scheme will therefore not be burdened by the cost of collection, and it will have no effect on the administrative budget and levies payable by owners.
